We refer to the Company’s announcement made on 26 January 2017.

In furtherance to the abovementioned announcement, Rimbunan Melati Sdn Bhd (“Rimbunan Melati”) had properly filed its application to the Court on 8 June 2017 for a declaration that the dispute in this proceeding and the arbitration claim initiated by EK Integrated Construction Sdn Bhd (“EK”) against Rimbunan Melati to be consolidated and to be heard by the same single arbitrator for decision.

This action was initiated pursuant to the Court’s view handed out on 21 April 2017 that it has no discretion to grant an order to direct the dispute under this proceeding to be consolidated under Section 10(2) of the Arbitration Act 2005 with the ongoing arbitration claim initiated by EK. The Court had instead informed that Rimbunan Melati may file an application to the Court for a declaration that the disputes should be consolidated and heard by a single and same arbitrator. The Court’s view was given in reply to the earlier application made by EK for stay of this Court’s proceeding pending the conclusion of their arbitration claim against Rimbunan Melati.
